Terms of Service

By accessing or using WhoGetsMe at https://whogetsme.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Ahmet Şınka ("we", "us", or "our"), the individual who operates and maintains WhoGetsMe. The Terms apply to all visitors, users, and anyone who accesses or uses the Service, including quiz creators and quiz participants.

WhoGetsMe is a free, browser-based quiz game. It allows users to:

• Create a personal quiz by selecting pre-written questions or writing custom questions about themselves
• Share the quiz with friends via a unique code or link
• Invite others (participants) to answer the questions by entering a nickname and submitting their answers
• View a ranked leaderboard showing how well each participant knows the quiz creator

The Service uses Firebase Anonymous Authentication to assign each browser session a random identifier, and Google Cloud Firestore to store quiz data, answer keys, and participant results. No account registration, email address, or password is required.

We reserve the right to modify, expand, or discontinue any feature of the Service at any time. We will update these Terms before introducing material changes such as paid features or advertising.

The Service is intended for users of all ages who have the ability to form a legally binding contract with us. By using the Service, you represent that:

• You are at least 13 years of age (or the applicable minimum digital age of consent in your country)
• You are not prohibited by applicable law from accessing or using the Service
• You will use the Service in accordance with these Terms and all applicable laws

WhoGetsMe is a general-audience application. We do not knowingly provide the Service to children under 13 without verifiable parental consent. If you are a parent or guardian and believe your child has submitted personal data through the Service, please contact us at ahmet.sinka5555@gmail.com and we will promptly remove the data.

When using WhoGetsMe, you are responsible for your own conduct and for the content you create or submit. You agree to:

• Use a nickname that does not impersonate another person or contain another person's personal information
• Create questions and answers that do not violate applicable law or the rights of others
• Share your quiz link only with people who are willing to participate
• Not use the Service to collect personal information from others without their knowledge
• Not attempt to access quiz data or answer keys belonging to other users
• Not use automated tools, bots, or scripts to interact with the Service
• Keep your quiz code confidential if you do not want strangers to participate

Because the Service uses anonymous authentication, you are solely responsible for keeping your quiz code safe. We have no mechanism to verify your identity across different browser sessions or devices.

WhoGetsMe allows you to write custom quiz questions (up to 120 characters each) in addition to selecting from a pre-written library. You retain responsibility for the content of any custom questions or answers you create.

Content You Create

By submitting custom quiz content, you grant us a limited, non-exclusive, royalty-free licence to store and display that content solely for the purpose of operating the Service. You are solely responsible for ensuring that your custom questions and answer options do not:

• Contain personally identifiable information about third parties without their consent
• Harass, threaten, defame, or demean any individual or group
• Infringe any copyright, trademark, or other intellectual property right
• Violate any applicable law or regulation

Sharing

When you share a quiz link or code, anyone who receives it can participate. We have no control over who you share the code with. Please share responsibly. If you wish to stop participation in your quiz, you can delete it through the owner results screen.

You may not use WhoGetsMe for any of the following purposes:

• Creating or sharing content that is obscene, hateful, threatening, or promotes violence
• Collecting personal data from participants without a lawful basis under applicable data protection law
• Impersonating another person, including using someone else's name as your quiz creator nickname
• Attempting to circumvent, disable, or interfere with security features of the Service
• Probing, scanning, or testing the vulnerability of the Service or its underlying infrastructure
• Attempting to gain unauthorised access to quiz data, answer keys, or other users' results
• Submitting spam, phishing content, or malicious links through quiz question or nickname fields
• Using the Service in any way that violates applicable local, national, or international law
• Reselling, sublicensing, or commercially exploiting any part of the Service without our written permission

We reserve the right to delete any quiz or result that violates these prohibitions, and to block access to the Service for users who engage in prohibited conduct, without prior notice.

Our Intellectual Property

The WhoGetsMe application, including its design, user interface, pre-written question library, source code, graphics, and branding, is the intellectual property of Ahmet Şınka. All rights not expressly granted in these Terms are reserved. You may not copy, reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Service without our express written permission.

Your Content

You retain ownership of any custom quiz questions and answers you create. By submitting them to the Service, you grant us only the limited licence described in Section 5 above. We do not claim ownership of your content and will not use it outside the context of operating the Service.

We aim to keep WhoGetsMe available at all times, but we do not guarantee continuous, uninterrupted access to the Service. The Service may be temporarily unavailable due to planned or unplanned maintenance, technical failures, or internet connectivity issues beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We may add or remove features, change the pre-written question library, or alter the quiz structure in future versions.

The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or free of harmful components
• Warranties that quiz data will be stored permanently or will never be lost
• Warranties that the Service will meet your requirements or expectations

Some jurisdictions do not allow exclusion of implied warranties. In such jurisdictions, our liability is limited to the minimum required by law.

To the fullest extent permitted by applicable law, Ahmet Şınka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to loss of data, quiz content, results, profits, revenue, or any harm arising from content created or shared by other users.

This limitation applies regardless of the legal theory under which the claim is brought, even if we have been advised of the possibility of such damages.

You may stop using the Service at any time. Because no account registration is required, there is nothing to deactivate. If you wish to delete your quiz data, you may do so from the owner results screen, or by contacting us at ahmet.sinka5555@gmail.com with your quiz code.

We reserve the right to restrict or terminate your access to the Service, or to delete specific quiz content, at our sole discretion and without prior notice, if we determine that you have violated these Terms or that your use of the Service causes harm to others or to the Service itself.

Your use of WhoGetsMe is also governed by our Privacy Policy. The Privacy Policy describes in detail what data we collect, why, how long we retain it, and what rights you have over it. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

These Terms are governed by the laws of the Republic of Austria, where Ahmet Şınka is currently based, without regard to its conflict-of-law provisions.

For users located in the European Union, mandatory consumer protection laws of your country of residence may also apply and cannot be excluded by these Terms.

For users located in Türkiye, these Terms are additionally subject to applicable Turkish consumer protection and data protection legislation, including KVKK (Law No. 6698).

We may update these Terms of Service from time to time. When we make material changes, we will update the effective date at the top of this document. Material changes include, but are not limited to, the introduction of paid features, advertising, new data collection practices, or significant changes to user rights.

Because WhoGetsMe does not collect email addresses, we cannot notify users of changes directly. We recommend bookmarking this page and reviewing it periodically, especially before creating a new quiz.

Your continued use of the Service after updated Terms are published constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.
